Terms of Use
Last updated:
These terms are a contract between you and Neovate s.r.o. (“we”, “us”), the company that operates QandA.fun: the website qanda.fun and the QandA.fun apps. They are the rules for using QandA.fun, and by using it you agree to them. Our Privacy Policy explains how we handle your data.
Who we are
QandA.fun is operated by Neovate s.r.o., a limited liability company registered in the Czech Republic, with its registered office at Branická 213/53, Braník, 147 00 Praha 4, Czech Republic, Company ID (IČO) 23036028, VAT ID CZ23036028, entered in the Commercial Register kept by the Municipal Court in Prague, section C, insert 420347. You can reach us at [email protected].
Using QandA.fun
QandA.fun lets you create quizzes and themes, host live games, play as a guest or with an account, and share quizzes with other people. It’s free. We may add, change or remove features and limits, such as the limits of 100 players per game and 100 questions per quiz.
You must be at least 13 to use QandA.fun, as a guest player too, and at least 18 to use Create with AI and AI suggestions. If you are under 18, ask a parent or guardian before you create an account. If you host games for others, such as a class, you are responsible for making sure every player is at least 13.
Accounts and guest play
- You sign in with a one-time link or 8-digit code we email you, which expire after 15 minutes, or with Google. There are no passwords. Keep your email account secure: anyone who can read your email can sign in as you. You are responsible for what happens under your account.
- You can play without an account. Your browser keeps your guest sign-in for up to 30 days; if you clear your browser’s data or it expires, you start again as a new guest. Sign in with “Keep my identity” to keep your games, XP and streak.
- Your public name and the nicknames you choose must follow these terms. Don’t impersonate other people or organisations.
Your content
- You keep ownership of the quizzes, themes, files, names and answers you create on QandA.fun (“your content”).
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt and distribute your content, only as needed to run and provide the service: for example, to show a question on a projector and on players’ phones, to resize an image, or to include your answers in the host’s report.
- When you publish a quiz or theme, anyone can see it. Other users can play and host a published quiz, copy it to their own account with Duplicate and edit their copy, and use or fork a published theme. You give every QandA.fun user permission to do this. Copies made while your content was public stay with their owners if you later make your original private or delete it.
- Answers you give and words you send in a game are shown to its host and, where the game shows them, to the other players.
- You confirm that you have the rights to everything you upload, link or publish, including images, audio, video and question text, and that it doesn’t break these terms or anyone else’s rights.
- This licence ends when you delete your content or your account, except for copies other users made of content you published, and for copies already frozen into other people’s games, challenges or assignments, or into a Quiz of the Day edition that has already gone out.
Acceptable use
We have zero tolerance for objectionable content and abusive users. Don’t create, upload, link to, publish or send any of the following, in a quiz, theme, name, nickname, answer or anywhere else on QandA.fun:
- sexual or sexually suggestive content, and anything that sexualises minors;
- hateful content that attacks or demeans people for who they are, such as their race, ethnicity, nationality, religion, disability, sex, gender identity or sexual orientation;
- harassment, bullying, threats or intimidation, including of other players;
- violent, gory or shocking content, or content that encourages violence, self-harm or dangerous acts;
- illegal content, or content that promotes illegal activity;
- other people’s personal information, such as their address, phone number, photos or private messages, without their permission;
- spam, scams, misleading content or advertising;
- content that infringes someone else’s copyright, trademark or other rights.
Don’t misuse the service either. Don’t try to break its security or reach other people’s accounts or data, don’t overload it or get around its limits, don’t copy it in bulk with automated tools, don’t send automated players into games you don’t host, and don’t use QandA.fun to break the law.
Hosts are responsible for the games they run, including the quizzes they choose and who they invite. A host can remove a player from a game, and that player can’t rejoin it.
Reporting and blocking
- If you see something that breaks these terms, use Report quiz or Report theme on the quiz’s or theme’s page, or Report this quiz where you play it: in a game (in the lobby of a hosted game, at the end, after you were removed, or on the join screen of a game you can’t join), in an auto room (in its lobby, after you were removed or once it closed), on the Quiz of the Day page, or on a friend challenge’s or assignment’s page. Choose a reason (sexual content, hate or harassment, violence or dangerous acts, spam or misleading, copyright or someone else’s work, personal information, or something else) and add a note if you like.
- To report a player, for their nickname, a host’s or room owner’s public name, or an answer or word on the big screen, use Report a player or Report an answer or word where you saw it: in a game’s lobby, results or end screen, after you were removed, in an auto room, on the Quiz of the Day list or on a friend challenge’s board. Hosts find the same options in their lobby, at the reveal of typed answers and on the end screen. Choose a reason (an offensive or inappropriate name, an offensive answer or word, bullying or harassment, spam, or something else). We keep a copy of what you reported as evidence.
- Use Block author on a quiz’s or theme’s page, or next to Report this quiz in a game, room, the Quiz of the Day or a challenge, to stop seeing that author’s quizzes, themes and public games on Explore, Themes and Play now. Block a player, from the same place you would report them, to also show their nickname as “Blocked player” on your screens where you play and to stop them joining games you host (the host screen of your own game still shows nicknames, so you can remove a player). You can unblock them on your profile.
- We aim to review reports within 24 hours and act on objectionable content promptly. Nobody learns who reported them or their content.
To notify us of content you believe is illegal, you can also email [email protected] with where it is (a link, or the game or room code), why you believe it is illegal, your name and email address, and a statement that you believe in good faith that your notice is accurate and complete. You don’t have to give your name to report child sexual abuse material. We confirm that we received your notice and tell you what we decided.
Moderation and enforcement
We may review content that is reported or publicly visible. We may hide or remove content, stop it from being published, and suspend or delete accounts that break these terms, without notice when that is needed to protect others.
- Blocked words. Some words are refused automatically in public names, nicknames, tags and theme names, and are kept off the host’s screen in word clouds. When the title, description or a question of a public quiz, or of a quiz listed on Play now, contains one, the quiz stays published and is flagged for our review. This filter is the only automated tool we use for moderation; the people who decide on reports are our moderators.
- Hiding. A hidden quiz or theme becomes private and can’t be published again until we lift it. Its author can still see and edit it. A hidden quiz also leaves Play now and the Quiz of the Day, and friend challenges of it stop.
- Removing a player’s nickname and answers. We may replace a player’s nickname in a game, room or challenge with “Removed player”, take it off the Quiz of the Day list, remove the answers and words they typed in that game, or clear a host’s or room owner’s public name. Their score stays.
- Suspension. A suspended account’s public quizzes and themes become private, and until we lift the suspension it can’t publish, list games or rooms publicly, change its public name, join other people’s games or rooms, send typed answers or words in a hosted game, or create friend challenges, and its name isn’t shown on the Quiz of the Day top list or on friend challenge boards. It can still play solo and host private games, and it can still delete itself; the suspension is deleted with the account.
When we hide your content, remove your nickname or answers, or suspend your account, you see it in the app. Email [email protected] and we will tell you the reasons: the content concerned, the rule or law we applied, how long the measure lasts and whether automated tools were involved. If you think we made a mistake, tell us and a person will review the decision. This doesn’t take away your right to go to court.
AI features
- Create with AI and AI suggestions are only for users 18 or older. You confirm your age, and that you agree to send your material to the AI service, before you first use them.
- They write questions automatically. They can be wrong, out of date or inappropriate, so check everything before you host or publish it. If they write something offensive, harmful or wrong, use Report AI content in the editor’s AI menu (or Report on a suggestion) so we can review it. You are responsible for content you publish, even if AI helped write it. Only submit text you are allowed to use, and don’t include personal information about pupils, other children or anyone else.
- AI grading checks open answers that don’t match an accepted answer. It can mark a right answer wrong or a wrong answer right, and if it isn’t available in time, an answer may be marked wrong. Scores, ranks, XP and leaderboards are for fun and come with no guarantee.
- AI grading is made for quiz games. Don’t use AI grades alone to make decisions about people, such as school marks: check the answers in the game’s report yourself.
A free service, as it is
QandA.fun is provided free of charge, “as is” and “as available”. We work to keep it running and your data safe, but we don’t promise that it will always be available, error-free or secure, that content made by other users is accurate or appropriate, or that your content, games or results will never be lost.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for any loss of data, content, results or profits, arising from your use of the service or from content made by other users. Nothing in these terms limits our liability for harm we cause intentionally or through gross negligence, for harm to a person’s life or health, or any other liability that cannot be limited by law, or your rights as a consumer under the law where you live.
Other websites and services
Quizzes can include media and links from other websites, such as YouTube videos. Those websites have their own terms and policies, and we are not responsible for them.
Ending your use
You can stop using QandA.fun at any time and delete your account or guest data yourself. See Delete your account and data. We may suspend or end your access if you break these terms or if the law requires it.
Changes to these terms
We may update these terms. When we do, we change the date at the top, and if a change is significant, we will announce it on QandA.fun before it takes effect. If you don’t agree with the new terms, you can stop using QandA.fun and delete your account or guest data; if you keep using it after that, you accept them.
Governing law and courts
These terms are governed by the law of the Czech Republic. If you are a consumer, this doesn’t take away the protection of the mandatory laws of the country where you live. Disputes go to the competent Czech courts; if you are a consumer living in the European Union, you may also bring proceedings in the courts where you live, and we can bring proceedings against you only there.
Out-of-court dispute resolution
If you are a consumer and we can’t settle a dispute with you directly, you may be able to submit it for out-of-court resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce), Ústřední inspektorát, oddělení ADR, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, [email protected], coi.gov.cz/informace-o-adr, where the Czech law on out-of-court consumer dispute resolution applies to your dispute. The European Consumer Centre in your country can help with cross-border disputes free of charge.
